1ข้อมูลทั่วไป
เอกสารที่ออกโดยหน่วยงานของออสเตรีย สโลวาเกีย หรือสโลวีเนีย (เช่น ทะเบียนสมรส เอกสารจดทะเบียนธุรกิจ รายละเอียดสินค้า) จะใช้ในประเทศไทยได้ต่อเมื่อผ่านการรับรองตามลำดับขั้นตอน (chain of legalisation) ตามกฎหมายและระเบียบของไทยและของประเทศที่ออกเอกสาร
ลำดับขั้นตอนการรับรองเอกสาร
โดยทั่วไป เอกสารต้นฉบับและคำแปล (ถ้ามี) ต้องผ่านการรับรองตามลำดับดังนี้
- รับรองโดยหน่วยงานต้นทางของออสเตรีย/สโลวาเกีย/สโลวีเนีย
อาจมีมากกว่า 1 หน่วยงาน กรุณาสอบถามกระทรวงการต่างประเทศของประเทศนั้นว่าต้องติดต่อหน่วยงานใดก่อน แล้วจึงนำเอกสารไปยื่นที่กระทรวงการต่างประเทศ
- รับรองโดยกระทรวงการต่างประเทศออสเตรีย/สโลวาเกีย/สโลวีเนีย
กระทรวงฯ จะรับรองลายมือชื่อเจ้าหน้าที่ของหน่วยงานต้นทางหากต้องแปลเป็นภาษาไทย ให้แปลโดยล่ามที่ได้รับการรับรองจากศาล หลังจากเอกสารผ่านการรับรองจากกระทรวงการต่างประเทศออสเตรีย/สโลวาเกีย/สโลวีเนียแล้ว
- รับรองโดยสถานเอกอัครราชทูต ณ กรุงเวียนนา
สถานเอกอัครราชทูตจะรับรองลายมือชื่อเจ้าหน้าที่กระทรวงการต่างประเทศออสเตรีย/สโลวาเกีย/สโลวีเนีย และรับรองคำแปลภาษาไทย
- รับรองโดยกรมการกงสุล กระทรวงการต่างประเทศ
กรมการกงสุลจะรับรองลายมือชื่อเจ้าหน้าที่กงสุลของสถานเอกอัครราชทูต

- สถานเอกอัครราชทูตไม่รับรองลายมือชื่อของบุคคลสัญชาติอื่น ยกเว้นลายมือชื่อนั้นผ่านการรับรองจาก Notary Public และกระทรวงการต่างประเทศออสเตรีย สโลวาเกีย หรือสโลวีเนียได้รับรองลายมือชื่อของ Notary Public แล้ว
การแปลเอกสาร
ไม่ได้บังคับว่าต้องแปลเป็นภาษาอังกฤษหรือภาษาไทยในทุกกรณี กรุณาสอบถามหน่วยงานที่จะนำเอกสารไปยื่นโดยตรง
โดยทั่วไป
- เอกสารออสเตรียที่จะใช้ยื่นเปลี่ยนสถานะครอบครัวในไทย ให้แปลเป็นภาษาไทยโดยล่ามที่ได้รับการรับรองจากศาลออสเตรีย
- เอกสารทะเบียนครอบครัวของสโลวาเกียและสโลวีเนีย ให้แปลเป็นภาษาอังกฤษ เมื่อถึงไทยต้องแปลเป็นภาษาไทย แล้วนำไปรับรองที่กรมการกงสุล กระทรวงการต่างประเทศ ก่อนยื่นที่อำเภอที่ผู้ร้องฝ่ายไทยมีชื่ออยู่ในทะเบียนบ้าน เพื่อเปลี่ยนสถานะครอบครัว

2ขั้นตอนการยื่นคำร้อง
2.1 เอกสารที่ต้องใช้และค่าธรรมเนียม
- แบบฟอร์มคำร้องขอรับรองเอกสาร กรอกครบถ้วนและลงนามแล้ว
- เอกสารต้นฉบับที่จะขอรับรอง พร้อมคำแปล (ถ้ามี) และสำเนาทุกหน้าถ่ายสำเนาหลังจากเอกสารผ่านการรับรองจากกระทรวงการต่างประเทศออสเตรีย/สโลวาเกีย/สโลวีเนียแล้ว
- คำแปลภาษาไทยและสำเนาคำแปล (เฉพาะกรณีที่ต้องแปล)แปลเป็นภาษาไทยหลังจากเอกสารผ่านการรับรองจากกระทรวงการต่างประเทศออสเตรีย/สโลวาเกีย/สโลวีเนียแล้ว
- ค่าธรรมเนียมรับรองเอกสาร (เงินสดเท่านั้น ไม่คืนเงิน)

ข้อควรทราบ คำร้องที่เอกสารไม่ครบหรือค่าธรรมเนียมไม่พอตามข้อ 2.1 จะไม่ได้รับการพิจารณา

3เอกสารไทยที่จะนำไปใช้ในสโลวีเนีย
เนื่องจากไม่มีสถานเอกอัครราชทูตสโลวีเนียในประเทศไทย สถานเอกอัครราชทูต ณ กรุงเวียนนา จึงอนุโลมให้นำเอกสารไทยมารับรองเพื่อนำไปใช้ในสโลวีเนียได้
- รับรองโดยกรมการกงสุล กระทรวงการต่างประเทศ
ต้องทำที่ประเทศไทยก่อนนำเอกสารมายื่นที่สถานเอกอัครราชทูต
- รับรองโดยสถานเอกอัครราชทูต ณ กรุงเวียนนา

หากเอกสารยังไม่ผ่านการรับรองจากกรมการกงสุล ต้องมาทำหนังสือมอบอำนาจที่สถานเอกอัครราชทูตก่อน เพื่อมอบอำนาจให้ผู้ที่อยู่ในไทยนำเอกสารไปรับรองที่กรมการกงสุลแทน ข้อมูลและแบบฟอร์มหนังสือมอบอำนาจ
Legalisation von österreichischen, slowakischen und slowenischen Dokumenten/Urkunden
1Allgemeine Informationen
Um in Thailand rechtlich anerkannt zu werden, müssen von österreichischen, slowakischen oder slowenischen Behörden ausgestellte Urkunden und amtliche Dokumente (z. B. Heiratsurkunden, Gewerbe- bzw. Unternehmensregistrierungsunterlagen, Produktspezifikationen usw.) gemäß den einschlägigen thailändischen sowie österreichischen, slowakischen oder slowenischen Gesetzen und Anforderungen ordnungsgemäß im Rahmen der entsprechenden „Legalisation Chain“ legalisiert werden.
Legalisation Chain
Grundsätzlich müssen die Originaldokumente und deren Übersetzungen (sofern vorhanden) die folgenden Schritte durchlaufen:
- Beglaubigung durch die zuständigen Primärbehörden in Österreich/der Slowakei/Slowenien
Gegebenenfalls durch mehr als eine Behörde. Bitte wenden Sie sich vor der Einreichung der Dokumente an das zuständige Außenministerium, um zu erfahren, welche Primärbehörden zunächst kontaktiert werden müssen.
- Legalisation durch das Außenministerium von Österreich/der Slowakei/Slowenien
Das Außenministerium beglaubigt die Unterschriften der zuständigen Bediensteten der Primärbehörden.Falls eine thailändische Übersetzung erforderlich ist, muss sie durch einen beeideten und gerichtlich zertifizierten Übersetzer angefertigt werden, nachdem die Dokumente vom Außenministerium Österreichs, der Slowakei oder Sloweniens legalisiert worden sind.
- Legalisation durch die Königlich Thailändische Botschaft in Wien
Die Botschaft beglaubigt die Unterschriften der Bediensteten des Außenministeriums von Österreich/der Slowakei/Slowenien und erkennt die ins Thailändische übersetzten Dokumente an.
- Legalisation durch das Außenministerium von Thailand
Das Ministerium beglaubigt die Unterschriften der Konsularbeamten der Königlich Thailändischen Botschaft.
Wichtig
- Die Königlich Thailändische Botschaft in Wien akzeptiert AUSSCHLIESSLICH Dokumente, die ordnungsgemäß durch das Außenministerium Österreichs, der Slowakei oder Sloweniens legalisiert wurden. Dokumente, die nicht durch das Außenministerium Österreichs, der Slowakei oder Sloweniens legalisiert wurden, werden zurückgewiesen.
- Die Königlich Thailändische Botschaft in Wien akzeptiert keine Anträge auf Beglaubigung der Unterschrift einzelner ausländischer Staatsangehöriger, es sei denn, die Unterschrift der betreffenden Person wurde ordnungsgemäß durch einen Notar beglaubigt UND das Außenministerium Österreichs, der Slowakei oder Sloweniens hat die Unterschrift des Notars bereits beglaubigt.
Übersetzung
Eine Übersetzung ins Englische oder Thailändische ist nicht in jedem Fall vorgeschrieben. Bitte erkundigen Sie sich direkt bei der Behörde, bei der Sie die Dokumente einreichen werden.
Im Allgemeinen gilt:
- Österreichische Dokumente zur Änderung des Familienstands in Thailand: Übersetzung ins Thailändische durch einen von einem österreichischen Gericht zertifizierten Dolmetscher.
- Slowakische und slowenische Personenstandsdokumente: Übersetzung ins Englische. In Thailand müssen die Dokumente anschließend ins Thailändische übersetzt und vom Department of Consular Affairs des thailändischen Außenministeriums legalisiert werden, bevor sie zur Änderung des Familienstands beim Bezirksamt (Amphoe) eingereicht werden, bei dem die thailändische Antragstellerin bzw. der thailändische Antragsteller gemeldet ist.

2Antragsverfahren
2.1 Erforderliche Unterlagen und Gebühren

Hinweis: Das Porto kann je nach Größe und Gewicht der Dokumente höher ausfallen. Der Antragsteller ist dafür verantwortlich, sicherzustellen, dass das Porto für die Rücksendung der Dokumente ausreichend ist.
2.2 Einreichung des Antrags
Option 1: Persönlich
- Termin für die Legalisation online buchen
- Besuchen Sie am vereinbarten Termin die Königlich Thailändische Botschaft in Wien (Cottagegasse 48, 1180 Wien), um die unter Punkt 2.1 genannten Dokumente einzureichen.
Option 2: Per Post
Senden Sie die unter Punkt 2.1 genannten Dokumente per Einschreiben an:

Wichtig: Anträge, die mit unvollständigen Unterlagen oder unzureichenden Gebühren gemäß Punkt 2.1 eingereicht werden, werden zurückgewiesen.
2.3 Bearbeitungszeit und Rücksendung der Dokumente
- Die Botschaft sendet die Dokumente innerhalb von 5 Werktagen ab dem Datum des Eingangs der (vollständigen) Unterlagen in dem vom Antragsteller bereitgestellten Umschlag zurück.
- Eine persönliche Abholung der legalisierten Dokumente kann in dringenden Fällen ausnahmsweise gestattet werden. Der Antrag auf persönliche Abholung muss bei Einreichung des Antrags gestellt werden.
- Die Botschaft übernimmt keine Verantwortung für Beschädigung oder Verlust von Postsendungen oder darin enthaltenen Gegenständen.
- Wenn Sie die legalisierten Dokumente innerhalb von 2 Wochen nach dem Datum der Einreichung bzw. Versendung der Dokumente an die Botschaft nicht erhalten haben, kontaktieren Sie bitte die Botschaft per E-Mail: consular@thaiembassy.at
3Thailändische Dokumente zur Verwendung in Slowenien
Da es in Thailand keine slowenische Botschaft gibt, kann die Königlich Thailändische Botschaft in Wien ausnahmsweise thailändische Dokumente zur Verwendung in Slowenien legalisieren.
- Legalisation durch das Department of Consular Affairs des thailändischen Außenministeriums
Dieser Schritt muss in Thailand erfolgen, bevor die Dokumente bei der Botschaft eingereicht werden.
- Legalisation durch die Königlich Thailändische Botschaft in Wien
Reichen Sie die Dokumente gemäß dem Verfahren unter Punkt 2 ein.

Wurden Ihre Dokumente noch nicht durch das Außenministerium von Thailand legalisiert, müssen Sie zunächst bei der Botschaft eine Vollmacht errichten, mit der Sie eine Person in Thailand bevollmächtigen, die Dokumente in Ihrem Namen beim Außenministerium von Thailand zur Legalisation einzureichen. Legalisation of Austrian, Slovak and Slovene Documents/Certificates
1General information
To be legally recognised in Thailand, certificates and official documents issued by Austrian, Slovak or Slovene authorities (e.g. marriage certificates, business registration documents, product specifications, etc.) must be duly legalised through the applicable “chain of legalisation”, in accordance with the relevant Thai and Austrian, Slovak or Slovene laws and requirements.
Chain of legalisation
In general, the original documents and their translations (if any) need to go through the following steps:
- Authentication by primary agencies of Austria/Slovakia/Slovenia
May involve more than one agency. Please contact your Ministry of Foreign Affairs for information on which primary agencies to approach before submitting the documents to the Ministry of Foreign Affairs.
- Legalisation by the Ministry of Foreign Affairs of Austria/Slovakia/Slovenia
The Ministry will certify the signatures of the officers of the primary agencies.If a Thai translation is required, it must be made by a sworn and court-certified translator after the documents have been legalised by the Ministry of Foreign Affairs of Austria/Slovakia/Slovenia.
- Legalisation by the Royal Thai Embassy in Vienna
The Embassy will certify the signatures of the officers of the Ministry of Foreign Affairs of Austria/Slovakia/Slovenia and will recognise the Thai-translated documents.
- Legalisation by the Ministry of Foreign Affairs of Thailand
The Ministry will certify the signatures of the Royal Thai Embassy’s consular officers.
Important
- The Royal Thai Embassy in Vienna will accept ONLY documents that are duly legalised by the Ministry of Foreign Affairs of Austria, Slovakia or Slovenia. Documents that are not legalised by the Ministry of Foreign Affairs of Austria, Slovakia or Slovenia will be rejected.
- The Royal Thai Embassy in Vienna will not accept requests for certifying signatures of individual foreign nationals, unless the person’s signature has been duly certified by a Notary Public AND the Ministry of Foreign Affairs of Austria, Slovakia or Slovenia has already certified the Notary Public’s signature.
Translation
Translation into English or Thai is not compulsory in every case. Please check directly with the authority where you will submit the documents.
In general:
- Austrian documents for changing family status in Thailand: translate into Thai by an interpreter certified by an Austrian court.
- Slovak and Slovene civil registration documents: translate into English. In Thailand, the documents must then be translated into Thai and legalised by the Department of Consular Affairs, Ministry of Foreign Affairs of Thailand, before being submitted to the district office (Amphoe) where the Thai applicant is registered, in order to change family status.

2Application procedures
2.1 Required documents and fees

- Envelope addressed to the applicant’s own address and postal fee for return of documents (cash only, non-refundable)

NB: The postal fee may be higher depending on the size and weight of the documents. The applicant is responsible for ensuring that the postal fee is adequate for the return of documents.
2.2 Submit application
Option 1: In person
- Book a legalisation appointment online
- Visit the Royal Thai Embassy in Vienna (Cottagegasse 48, 1180 Vienna) on the day of your appointment to submit the documents listed in 2.1.

Send the documents listed in 2.1 via registered mail to:

Important: Applications sent with incomplete documents or inadequate fees as listed in 2.1 will be rejected.
2.3 Processing time and return of documents
- The Embassy will return the documents to the applicant in the envelope provided within 5 working days from the date of receipt of the complete documents.
- In-person pick-up of legalised documents may be permitted on an exceptional basis for urgent cases. Requests for in-person pick-up must be made when submitting the application.
- The Embassy does not take responsibility for any damage to, or loss of, postal packages or enclosed items.
- If you have not received the legalised documents within 2 weeks from the date of submitting/sending the documents to the Embassy, please contact the Embassy by email: consular@thaiembassy.at
3Thai documents for use in Slovenia
As there is no Slovenian Embassy in Thailand, the Royal Thai Embassy in Vienna may, as an exception, legalise Thai documents for use in Slovenia.

This step must be completed in Thailand before the documents are submitted to the Embassy.

Important
The Embassy will accept ONLY Thai documents that have already been legalised by the Ministry of Foreign Affairs of Thailand.
Document owner already in Slovenia?
If your documents have not been legalised by the Ministry of Foreign Affairs of Thailand, you must first make a power of attorney at the Embassy, authorising a person in Thailand to submit the documents to the Ministry of Foreign Affairs of Thailand for legalisation on your behalf.
